www.tripbelike.in (Website) is a travel activity booking platform owned and operated by
Teamtwin LLP (“TT”), a Limited Liabitity Partnership registered under the laws of India,
with its registered office at Door No 24/120B Kanjiramattom, Thodupuzha East, Kerala,
685585, hereinafter referred to as (“TT”/ “we”/ “us” or “our”).
We operate the Platform as an intermediary platform on which tours and Activities such as go
karting, watersports, other leisure, event ticketing (indoor gatherings) and fine dining at
restaurants or cafes (dating arrangements)(collectively referred as “Activity) are offered
online by a variety of local activity providers ("Activity Provider"). The descriptions,
photographs, and other content for its own Activities originate from the respective Activity
Provider. We therefore have no direct influence on such content.
2. SCOPE
This User Agreement constitute a legally binding agreement made between you, whether
personally or on behalf of an entity (“You/User”) and Teamtwin LLP (“TT”), concerning your
access to and use of the Website as well as mobile application related, linked, or otherwise
connected thereto (collectively, the “Platform”).
User by accessing or Platform,acknowledges and agrees to have read, understood, and agreed
to be legally bound by theseUser Agreement and our Privacy Policy. If you do not agree to
these User Agreement, please do not use or access our Platform.
Both User and TT are individually referred to as 'Party' and collectively referred to as
'Parties' to the User Agreement.
Supplemental terms and conditions or documents that may be posted on the site from time to
time are hereby expressly incorporated herein by reference. We reserve the right, in our
sole discretion, to make changes or modifications to this User Agreement at any time and for
any reason.
It is your responsibility to periodically review these Terms of Use to stay informed of
updates. You will be subject to, and will be deemed to have been made aware of and to have
accepted, the changes in any revised Terms of Use by your continued use of the Site after
the date such revised Terms of Use are posted.
3. ELIGIBILITY TO USE
The User must be at least 18 years of age and must possess the legal authority to enter into
an agreement so as become a User and use the services of TT. If you are a minor or are below
the age of 18 years, you shall not register as a User of the Platform and shall not transact
on or use thePlatform.
As a minor if you wish to use or transact on thePlatform, such use or transaction shall only
be made by a person of legal contracting age (legal guardian or parents).
We reserve the right to terminate your membership and/or block access to the Platform if it
is discovered that you are a minor or incompetent to contract according to the law or any
information pertaining to your age entered at the time of creation of account is false.
All rights and liabilities of the User and TT with respect to any services or product
facilitated by TT shall be restricted to the scope of this User Agreement.
4. ACCESS AND USE OF THE PLATFORM
The Platform is currently made available to you for your personal, non-commercial use, free
of charge.
We do not guarantee that access to the Platform, or any content on it, will always be
available or be uninterrupted. We may suspend, withdraw, discontinue or change all or any
part of the Platform without notice to you.
You must not misuse the Platform by knowingly introducing viruses, trojans, worms, logic
bombs or any other material which is malicious or technologically harmful.
You must not attempt to gain unauthorized access to the Platform, the server on which the
Platform is stored or any server, computer or database connected to the Platform.
You must not attack the Platform via a denial-of-service attack or a distributed denial-of
service attack.
We will report any such breach to the relevant law enforcement authorities and we will
co-operate with those authorities by disclosing your identity to them. In the event of such
a breach, your right to use the Platform will cease immediately.
5. CONTENTS
All content provided through the Platform, including but not limited to audio, images,
software, text, icons and such similar content ("Content"), are registered by TT and
protected under applicable copyright and/or intellectual property laws.
User are not allowed to monitor, copy, scrape/crawl, download, reproduce or otherwise use
anything on our Platform for any commercial purpose without written permission of TT.
User agrees to follow all instructions provided by TT which will prescribe the way such User
may use the Content.
There are a number of proprietary logos, service marks and trademarks displayed on the
Website and through other Sales Channels of TT, as may be applicable. TT does not grant the
User a license, right or authority to utilize such proprietary logos, service marks, or
trademarks in any manner. Any unauthorized use of the Content, will be in violation of the
applicable law.
6. LIMITED LIABILITY OF TT
TT always acts as a intermediary by connecting the User with the Activity Provider. TT does
not provide, own or control any of the Activity that you can access through our Platform .
The Activity are owned, controlled or made available by third parties, Activity Provider and
are responsible for the Activity and all booking contracts.
The Activity Provider’s terms and privacy policies apply to your booking, so you must agree
to, and understand those terms. Further, the terms of the individual operator of the
Activity which you plan to use, if different from the Activity Provider, will also apply to
your booking, so you must also agree to, and understand those terms.
Your interaction with any Activity Provider accessed through our Platform is at your own
risk, and TT does not have any responsibility should anything go wrong with your booking. TT
has no control over the Activity s and Activity Providers.
Any issues or concerns faced by the User at the time of availing any such services shall be
the sole responsibility of the Activity Provider. TT will have no liability with respect to
the acts, omissions, errors, representations, warranties, breaches or negligence on part of
any Activity Provider
Unless explicitly committed by TT as a part of any Activity.
TT assumes no liability for the standard of Activity as provided by the respective
Activity Provider.
TT provides no guarantee with regard to their quality or fitness as represented.
TT doesn’t guarantee the availability of any Activity as listed by a Activity Provider.
By making a booking, User understands TT merely provides a technology platform for booking
of Activity and the ultimate liability rests on the respective Activity Provider and not TT.
Thus the ultimate contract of service is between User and Activity Provider.
User further understands that the information displayed on the Website with respect to any
service is displayed as furnished by the Activity Provider. TT, therefore, cannot be held
liable in case if the information provided by the Activity Provider is found to be
inaccurate, inadequate or obsolete or in contravention of any laws, rules, regulations or
directions in force.
7. USER OBLIGATION
Users are advised to check the description of the Activity carefully before making a
booking. User(s) agree to be bound by all the conditions as contained in booking
confirmation or as laid out in the confirmed booking voucher. These conditions are also to
be read in consonance with the User Agreement.
If a User intends to make a booking on behalf of another person, it shall be the
responsibility of the User to inform such person about the terms of this Agreement,
including all rules and restrictions applicable thereto.
The User undertakes to abide by all procedures and guidelines, as modified from time to
time, in connection with the use of the services available through TT.
The User further undertakes to comply with all applicable laws, regulations, orders,
directions etc. issued by either the Central Government, State Government, District
Authorities or any other statutory body empowered to do so w.r.t use of services or for each
transaction.
As a user of the Platform you are responsible for any User Content (text, photos, reviews,
links, etc.) that you upload to TT. You must ensure that you have all the rights in respect
of any content which you upload or publish on the Platform and that any User Content does
not violate the rights of third parties.
Additionally, you agree not to use our Platform or its contents for any commercial purpose.
If your activity on our Platform shows signs of fraud, abuse or suspicious activity, TT may
deny its services to you, and close any associated accounts. If you have conducted any
fraudulent activity, TT reserves the right to take any necessary legal action and you may be
liable for monetary losses to TT, including litigation costs and damages.
User also authorizes TT's representative to contact such User over phone, message and email.
This consent shall supersede any preferences set by such User through national customer
preference register (NCPR) or any other similar preferences.
8. GUIDELINES FOR REVIEW
We may provide you areas on the Site to leave reviews or ratings. When posting a review, you
must comply with the following criteria:
you should have firsthand experience with the person/entity being reviewed
your reviews should not contain offensive profanity, or abusive, racist, offensive, or
hate language
your reviews should not contain discriminatory references based on religion, race,
gender, national origin, age, marital status, sexual orientation, or disability;
your reviews should not contain references to illegal activity;
you should not be affiliated with competitors if posting negative reviews;
you should not make any conclusions as to the legality of conduct;
you may not post any false or misleading statements;
you may not organize a campaign encouraging others to post reviews, whether positive or

We may accept, reject, or remove reviews in our sole discretion. We have absolutely no
obligation to screen reviews or to delete reviews, even if anyone considers reviews
objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily
represent our opinions or the views of any of our affiliates or partners.
We do not assume liability for any review or for any claims, liabilities, or losses
resulting from any review. By posting a review, you hereby grant to us a perpetual,
non-exclusive, worldwide, royalty-free, fully-paid, assignable, and sublicensable right and
license to reproduce, modify, translate, transmit by any means, display, perform, and/or
distribute all content relating to reviews.
We’re allowed to remove any review upon our discretion if it involves:
Politically sensitive comments
Promotional content
Illegal activities
Personal or sensitive information (e.g. emails, phone numbers or credit card info)
Swear words, sexual references, hate speech, discriminatory remarks, threats, or
references to violence
Spam and fake content
Animal cruelty
Impersonation (e.g. if the writer is claiming to be someone else)
9. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, or remove the contents of the Platform at any time
or for any reason at our sole discretion without notice. However, we have no obligation to
update any information on ourPlatform. We also reserve the right to modify or discontinue
all or part of the Platform without notice at any time.
We will not be liable to you or any third party for any modification, price change,
suspension, or discontinuance of the Platform.
We cannot guarantee the Platform will be available at all times. We may experience hardware,
software, or other problems or need to perform maintenance related to the Platform,
resulting in interruptions, delays, or errors.
We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify
the Platform at any time or for any reason without notice. You agree that we have no
liability whatsoever for any loss, damage, or inconvenience caused by your inability to
access or use the Platform during any downtime or discontinuance of the Site.
Nothing in these Terms of Use will be construed to obligate us to maintain and support the
Platform or to supply any corrections, updates, or releases in connection therewith.
10. LINKS TO THIRD PARTY SITES
Our Platform may contain hyperlinks to websites(“Linked Sites”) operated by parties other
than TT. Such hyperlinks are provided for your reference only. We do not control such Linked
Sites and are not responsible for their contents or the privacy or other practices of such
Linked Sites. These Terms will not apply to your use of any Linked Sites that you access via
our Platform. If a User accesses any third-party website, the same shall be done entirely at
the User’s risk and TT shall assume no liability for the same.
Further, it is up to you to take precautions to ensure that whatever links you select or
software you download (whether from our Platform or other Linked Sites) is free of such
items as viruses, worms, Trojan horses, defects and other items of a destructive nature. Our
inclusion of hyperlinks to such websites does not imply any endorsement of the material on
such websites or any association with their operators.
11. SECURITY AND ACCOUNT RELATED INFORMATION
While registering on the Platform, the User will have to choose a password to access the
User’s account and User shall be solely responsible for maintaining the confidentiality of
both the password and the account as well as for all activities on the account. It is the
duty of the User to notify TT immediately in writing of any unauthorized use of their
password or account or any other breach of security. TT will not be liable for any loss that
may be incurred by the User as a result of unauthorized use of the password or account,
either with or without the User’s knowledge. The User shall not use anyone else's account at
any time.
For logging-in or sign-up on the Website and/or mobile & web applications, the User has an
option to voluntarily sign-up or login through a phone number verification tool integrated
with a third-party partner of TT. For the avoidance of doubt, login or sign-up of the User
via such SDK verification process will at all times be subject to the User giving its
consent to TT for engaging the third-party partner. Under this login or sign-up option, no
Personal Information or Data of the User will be shared by TT with the third-party partner.
User understands that any information that is provided to this Website may be read or
intercepted by others due to any breach of security at the User’s end.
TT keeps all the data in relation to credit card, debit card, bank information etc. secured
and in an encrypted form in compliance with the applicable laws and regulations. However,
for cases of fraud detection, offering bookings on credit (finance) etc., TT may at times
verify certain information of its Users like their credit score, as and when required.
Additionally, TT may share your Personal Information in an anonymized and/ or aggregated
form with a third party that TT may engage to perform certain tasks on its behalf or to
fulfill the desired booking, including but not limited to payment processing, data hosting,
data processing , credit score and assessing credit worthiness for offering bookings on
credit in accordance with the applicable laws.
Additionally, TT may share your Personal Information in an anonymized and/ or aggregated
form with a third party that TT may engage to perform certain tasks on its behalf, including
but not limited to payment processing, data hosting, data processing , credit score and
assessing credit worthiness for offering bookings on credit in accordance with the
applicable laws.
TT adopts the best industry standard to secure the information as provided by the User.
However, TT cannot guarantee that there will never be any security breach of its systems
which may have an impact on User’s information too.
The data of the User as available with TT may be shared with concerned law enforcement
agencies for any lawful or investigation purpose without the consent of the User.
12. FEES ,PAYMENT AND REFUND POLICY
In addition to the cost of booking as charged by the, TT reserves the right to charge
certain fees in the nature of convenience fees or service fees. TT further reserves the
right to alter any and all fees from time to time. Any such additional fees, including fee
towards any modifications thereof, will be displayed to the User before confirming the
booking or collecting the payment from such User.
In cases of short charging of the booking amount, taxes, statutory fee, convenience fee
etc., owing to any technical error or other reason, TT shall reserve the right to deduct,
charge or claim the balance amount from the User and the User shall pay such balance amount
to TT. In cases where the short charge is claimed prior to the utilization of the booking,
TT will be at liberty to cancel such bookings if the amount is not paid before the
utilization date.
Any increase in the price charged by TT on account of change in rate of taxes or imposition
of new taxes, levies by Government shall have to be borne by the User. Such imposition of
taxes, levies may be without prior notice and could also be retrospective but will always be
as per applicable law.
In the rare circumstance of a booking not getting confirmed for any reason whatsoever, TT
will process the refund of the booking amount paid by the User and intimate the User about
the same. TT is not under any obligation to provide an alternate booking in lieu of or to
compensate or replace the unconfirmed booking. All subsequent bookings will be treated as
new transactions. Any refunds occasioned by cancellations (including user initiated
cancellations, Activity Provider initiated cancellations or force majeure related
cancellations) shall be processed as per the policies of the Activity Provider and subject
to receipt of refunds from Activity Provider. Activity Provider have absolute control over
the refund policy, and the Activity Provider is solely responsible for determining the
amount of refund to be provided. TT shall make all efforts to process refunds within 24
hours of receipt of refund from the Activity Provider. For refunds relating to transactions
more than 6 months old, TT shall make all efforts to process refunds within 96 hours post
receipt of refund from Activity Provider and receipt of banking details from customer.
Please reach out to the grievance officer if you have reason to believe that a refund has
not been processed within these timelines.
The User shall be completely responsible for all charges, fees, duties, taxes, and
assessments arising out of the use of the service, as per the applicable laws. The User
agrees and understands that all payments shall only be made to bank accounts of TT. TT or
its agents, representatives or employees shall never ask a customer to transfer money to any
private account or to an account not held in the name of TT. The User agrees that if that
user transfers any amount against any booking or transaction to any bank account that is not
legitimately held by TT or to any personal account of any person, TT shall not be held
liable for the same. User shall not hold any right to recover from TT any amount which is
transferred by the User to any third party.
The User will not share his personal sensitive information like credit/debit card number,
CVV, OTP, card expiry date, user IDs, passwords etc. with any person including the agents,
employees or representatives of TT. The User shall immediately inform TT if such details are
demanded by any of its agents' employees or representatives. TT shall not be liable for any
loss that the User incurs for sharing the aforesaid details.
Refunds, if any, on cancelled bookings will always be processed to the respective account or
the banking instrument (credit card, wallet etc.) from which payment was made for that
booking.
Booking(s) made by the User through TT are subject to the applicable cancellation policy as
set out on the booking page or as communicated to the customers in writing.
TT provides various modes of making payments on the Website for transacting, like UPI,
Credit/Debit Cards of various banks, Net Banking facility of all major banks, TT and third
party Wallets, Gift Cards, EMI and more.
13. USAGE OF THE MOBILE NUMBER, COMMUNICATION DETAILS OF THE USER BY TT
TT will send booking confirmation, itinerary information, cancellation, payment
confirmation, refund status, schedule change or any such other information relevant for the
transaction or booking made by the User, via SMS, internet-based messaging applications like
WhatsApp, voice call, e-mail or any other alternate communication detail provided by the
User at the time of booking.
TT may also contact the User through the modes mentioned above for any pending or failed
bookings, to know the preference of the User for concluding the booking and also to help the
User for the same.
The User hereby unconditionally consents that such communications via SMS, internet-based
messaging applications like WhatsApp, voice call, email or any other mode by TT are:
upon the request and authorization of the User;
‘transactional’ and not an ‘unsolicited commercial communication’ as per the guidelines
of Telecom Regulation Authority of India (TRAI), and
in compliance with the relevant guidelines of TRAI or such other authority in India and
abroad.
The User will indemnify TT against all types of losses and damages incurred by TTdue to any
action taken by TRAI, Access Providers (as per TRAI regulations) or any other authority due
to any erroneous complaint raised by the User on TT with respect to the communications
mentioned above or due to a wrong number or email id being provided by the User for any
reason whatsoever.
14. RIGHT TO REFUSE
TT at its sole discretion reserves the right to not accept any booking without assigning any
reason thereof.
TT will not provide any service or share confirmed booking details till such time the
complete consideration is received from the User.
In addition to other remedies and recourse available to TT under this User Agreement or
under applicable law, TT may limit the User's activity, warn other users of the User's
actions, immediately suspend or terminate the User's registration, or refuse to provide the
User with access to the Website if:
The User is in breach of this User Agreement; or
TT is unable to verify or authenticate any information provided by the User; or
TT believes that the User's actions may infringe on any third-party rights or breach any
applicable law or otherwise result in any liability for the User, other users of TT, or
TT itself.
Once a User has been suspended or terminated, such User shall not register or attempt to
register with TT with different credentials, or use the Website in any manner whatsoever
until such User is reinstated by TT. TT may at any time in its sole discretion reinstate
suspended users.
If a User breaches this User Agreement, TT reserves the right to recover any amounts due to
be paid by the User to TT, and to take appropriate legal action as it deems necessary.
The User shall not write or send any content to TT which is, or communicate with TT using
language or content which is:
violates third parties' intellectual property rights;
a spam; or
in breach of any other part of these terms and conditions of use.
If the User violates any of the aforesaid terms, TT shall be at liberty to take appropriate
legal action against the User.
15. RIGHT TO CANCEL
The User expressly undertakes to provide TT with correct and valid information while making
use of the Platform under this User Agreement, and not to make any misrepresentation of
facts. Any default on part of the User would disentitle the User from availing the services
from TT.
In case TT discovers or has reasons to believe at any time during or after receiving a
request for services from the User that the request for services is either unauthorized or
the information provided by the User or any of the travelers is not correct or that any fact
has been misrepresented by that User, TT shall be entitled to appropriate legal remedies
against the User, including cancellation of the bookings, without any prior intimation to
the User. In such an event, TT shall not be responsible or liable for any loss or damage
that may be caused to the User or any other person in the booking, as a consequence of such
cancellation of booking or services.
If any judicial, quasi-judicial, investigation agency, government authority approaches TT to
cancel any booking, TT will cancel the same without approaching the concerned User whose
booking has been cancelled.
The User shall not hold TT responsible for any loss or damage arising out of measures taken
by TT for safeguarding its own interest and that of its genuine customers. This would also
include TT denying or cancelling any bookings on account of suspected fraud transactions.
16. INSURANCE
Unless explicitly provided by TTin any specific service or deliverable, obtaining sufficient
insurance coverage is the obligation of the User. In no case TT shall accept any claims
arising out of such scenarios. Insurance, if any provided as a part of the service or
product by TT shall be as per the terms and conditions of the third-party insurance company.
TT merely acts as a facilitator in connecting the User with insurance company. The User
shall contact the insurance company directly for any claims or disputes. TT shall not be
held liable in case of partial acceptance or denial of the claims by the insurance company.
17. FORCE MAJEURE
There can be exceptional circumstances where TT and / or the Activity Provider may be unable
to honor the confirmed bookings due to various reasons like act of God, labor unrest,
insolvency, business exigencies, government decisions, terrorist activity, any operational
and technical issues, route and flight cancellations etc. or any other reason beyond the
control of TT. If TT has advance knowledge of any such situations where dishonor of bookings
may happen, it will make its best efforts to provide similar alternative to the User or
refund the booking amount after deducting applicable service charges, if supported and
refunded by that respective Activity Provider. The User agrees that TT being merely a
facilitator of the services and products booked, cannot be held responsible for any such
Force Majeure circumstance. The User has to contact the Activity Provider directly for any
further resolutions and refunds.
The User agrees that in the event of non-confirmation of booking due to any technical
reasons (like network downtime, disconnection with third party platforms such as payment
gateways, banks etc.) or any other similar failures, TT’s obligation shall be limited
refunding the booking amount, if any, received from the customer. Such refund shall
completely discharge TT from all liabilities with respect to that transaction. Additional
liabilities, if any, shall be borne by the User.
In no event shall TT and be liable for any direct, indirect, punitive, incidental, special
or consequential damages, and any other damages like damages for loss of use, data or
profits, arising out of or in any way connected with the use or performance of the Platform.
18. INDEMNIFICATION
The User agrees to indemnify, defend and hold harmless TT, its affiliates and their
respective officers, directors, lawful successors and assigns from and against any and all
losses, liabilities, claims, damages, costs and expenses (including legal fees and
disbursements in connection therewith and interest chargeable thereon) asserted against or
incurred by such indemnified persons, that arise out of, result from, or may be payable by
virtue of, any breach of any representation or warranty provided by the User, or
non-performance of any covenant by the User.
The User shall be solely liable for any breach of any country specific rules and regulations
or general code of conduct and TT cannot be held responsible for the same.
19. PRIVACY AND COOKIES
TT believes in protecting your privacy. Please click here to review our Privacy Policy and
click here to review our Cookie Policy. Any personal information that we collect about you
as you browse and use our Platform will be used in accordance with our Privacy Policy. To
find out more about the data we collect about you and how we use it please review our
current Privacy Policy, which also governs your use of the Platform and, as stated above, is
incorporated by reference.
20. SHIPPING AND DELIVERY
Shipping is not applicable for business.
21. MISCLLEANEOUS
SEVERABILITY: If any provision of this User Agreement is determined to be invalid or unenforceable
in whole or in part, such invalidity or unenforceability shall attach only to such provision
or part of such provision and the remaining part of such provision and all other provisions of
this User Agreement shall continue to be in full force and effect.
JURISDICTION: This Agreement is subject to interpretation as per the laws of India, and
the parties shall refer any unresolved disputes to the exclusive jurisdiction of courts in Ernakulam.
FEEDBACK FROM CUSTOMER: TT would like to know the feedback of the Users for improving
its services. The User hereby authorizes TT to contact the User for their feedback on various
services offered by TT. Such feedback may be collected through emails, telephone calls, SMS or
any other medium from time to time. In case the User chooses not to be contacted, such User shall
write to TT for specific exclusion at feedbacks@tripbelike.in
GRIEVANCE REDRESSAL: TT strongly believes in resolving the issues raised by the
User(s). In the event if user feels that it’s concern has not been resolved to it’s
satisfaction, User may contact our grievance officer, who shall endeavour to redress the
concern within 30 working days from the date of escalation. To reach the grievance officer
please use this link to submit the details. User(s) are advised to escalate to the grievance
officer only when they have already raised their complaint which has not been resolved to
their satisfaction, or their concern has not been resolved within 30 working days from the
date of ticket generation. User(s) will be required to share their booking reference number
and the ticket ID generated for their complaint, for any escalations to the Grievance Officer Harikrishnan V - grievanceofficer@tripbelike.in
In compliance of the Information Technology Act, 2000 and rules made thereunder and also in
compliance of the Consumer Protection (E-Commerce) Rules, 2020 the name and contact details
of the Grievance Officer are herein as under:
